PawCheck Creator Program Agreement

This is the agreement between you and Voltaix Group LLC covering the PawCheck Creator Program. It is the same for every creator. Please read it — it is the only document that says what you get paid, when, and what would stop it.
1. Who this is between
This agreement is between Voltaix Group LLC, a Florida limited liability company ("PawCheck", "we", "us"), and you, the individual applying to the Creator Program ("you", "Creator").
You accept it by ticking the box on the application form at pawcheck.co/creators. We record the date and the version you accepted.
It sits alongside our Terms of Use and Privacy Policy, which also apply to you as a PawCheck user. Where this agreement and those documents conflict on a Creator Program matter, this one governs.
2. Eligibility
- You must be 18 or older.
- You must give accurate information, and keep your email and payment details current. We pay what you tell us to pay; we cannot recover money sent to a wrong address you gave us.
- One account per person. Additional accounts created to earn commission on your own purchases, or to work around a suspension, may be closed.
- The Program is currently open to creators in the United States who can receive payment by PayPal. We may open it to other countries later; until we do, we cannot accept applications from outside the US.
3. Your referral code
We issue you a referral code and a link. You may ask for a specific code; if it is taken or unsuitable we will assign one.
The code is licensed to you, not owned by you. It stays ours. It is personal to you and cannot be sold, transferred or shared. We may change, suspend or reclaim a code — normally with notice, and immediately where it is being abused, impersonates someone, or infringes another party's rights.
You confirm that any code or display name you ask for is yours to use and does not infringe anyone else's trade mark or other rights.
4. Free PawCheck Pro
While you are an active Creator we give you PawCheck Pro at no charge. It is granted in 45-day periods and renews automatically while your account is active and in good standing. It is a promotional grant, not a purchase: it carries no refund value, and we may withdraw it if your account is suspended or closed.
If you already pay for PawCheck Pro, we do not grant a second entitlement and we do not cancel or refund the one you bought.
5. What you earn
Commission is 30% of the net amount we actually receive from a qualifying subscription — that is, after the app store takes its share. It is not a percentage of the price the customer pays.
A subscription qualifies when all of these are true:
- The customer entered your code in the PawCheck app before subscribing;
- They were not already a PawCheck subscriber; and
- They are not you. You do not earn commission on your own subscription, or on one bought through an account you control.
Commission is paid once per subscriber, on their first qualifying subscription. Renewals in later years do not pay again. Your code presents an annual plan only.
Attribution is based on the code recorded against the customer's account. If a customer enters more than one code, the first one recorded wins. If no code is recorded, no commission is due, whatever was said elsewhere.
We do not guarantee any level of earnings. Nothing here is a promise of a minimum, and there is no base pay.
6. When you get paid
Commission is earned when a qualifying subscription is paid for, and becomes payable 90 days later. That wait is the app store's refund window: until it closes, the money can still be taken back from us, and we will not pay out of funds that may be reversed.
Once your payable balance reaches $50.00, you can request a payout from your Creator Hub. We pay by PayPal, to the address you give us at the time of the request. Payouts are normally sent within 5 business days of approval.
We may hold a payout while we check a request, and we may decline one where we reasonably suspect fraud, abuse, or that the payment details are not yours.
7. Refunds, chargebacks and reversals
Commission is provisional until it is paid. If the underlying subscription is refunded, charged back, or reversed for fraud at any time, the related commission is cancelled.
If that happens before payout, the amount is simply removed from your balance.
If it happens after we have already paid you, we may set the amount off against your future commission. If no further commission arises within a reasonable period, we may ask you to repay it, and you agree to do so. We will always tell you what was reversed and why.
8. Tax
You are responsible for all taxes on anything we pay you. We pay gross and do not withhold, except where the law requires it.
We do not ask for tax information when you apply, and you do not need any to join or to use your code. It only becomes relevant if you are actually being paid.
Before we send your first payout we may ask you for your legal name and address, and — where it is required of us — a Form W-9. We may hold payment until you provide what we ask for. If you do not provide it, we may be required to withhold tax at the applicable backup rate, or to decline the payment.
Because we pay through PayPal, PayPal may report amounts you receive to tax authorities directly. That does not change your own obligation to declare what you receive.
9. You are an independent contractor
You take part in the Program as an independent contractor. This agreement does not make you an employee, agent, partner or joint venturer of Voltaix Group LLC, and it is not exclusive — you are free to work with anyone else, including our competitors.
You have no authority to speak for us, to bind us, to make promises on our behalf, or to represent yourself as PawCheck staff. You cover your own costs, equipment and taxes.
10. How you may promote PawCheck
You must disclose the relationship. Every post, video or story in which you use your code must make clear, clearly and conspicuously, that it is a paid or incentivised partnership — in line with the FTC Endorsement Guides and the rules of the platform you are posting on. A disclosure buried in a comment or hashtag block is not enough.
You must not:
- Send spam or unsolicited bulk messages of any kind;
- Buy, incentivise or fake reviews, ratings, installs or engagement;
- Bid on our brand names in paid search, or run ads that could be mistaken for ours;
- Say or imply that PawCheck diagnoses, treats, prevents or cures any condition;
- Present a PawCheck score as a veterinary opinion, a safety certification, or proof that a product is dangerous, toxic or recalled;
- Name a specific brand or product as unsafe on the basis of a score;
- Post content that is unlawful, hateful, sexual, or that targets children;
- Misrepresent the price, the trial length, or what a subscription includes.
PawCheck is not veterinary advice. It gives general product-safety guidance from label contents. If you talk about your pet's health, tell people to ask their vet.
11. Changes to the Program
We may change the commission rate, the hold period, the minimum payout and the Pro grant. Changes apply only to subscriptions attributed after the change takes effect — commission you have already earned is calculated at the rate that applied when you earned it, and we do not reprice it.
We will give you at least 30 days' notice of a change to the rate, by email to the address on your account. We may change the rest of this agreement on notice; if you carry on using your code after a change takes effect, you have accepted it.
12. Suspension and ending this agreement
You may leave at any time by telling us in your Creator Hub or at team@pawcheck.co.
We may suspend or end your participation, on notice, for any reason. We may do it immediately and without notice where we reasonably believe you have breached section 10, committed fraud, abused the Program, or created a legal risk for us.
What happens to your money. If your participation ends for any reason other than fraud or a serious breach, commission you have already earned is still paid once it becomes payable, whether or not it reaches the $50 minimum, to the payment details we hold. Where we end your participation for fraud or a serious breach, we may withhold unpaid commission connected to that conduct.
We will tell you the reason. Your code stops working when your participation ends.
13. If you disagree with a decision
If you think a commission, a reversal, a payout or a suspension is wrong, message us in your Creator Hub or email team@pawcheck.co. We aim to reply within 3 business days and will explain our reasoning. You can ask for a decision to be looked at again.
14. Liability
The Program is provided as is. To the fullest extent the law allows, we are not liable to you for lost profits, lost earnings, or indirect or consequential loss, and our total liability to you for any claim connected with the Program is limited to the commission we paid you in the 12 months before the claim arose.
You will indemnify us against claims arising from your promotion of PawCheck — including anything you said about it, and any failure to disclose the relationship as section 10 requires.
Nothing here limits liability that cannot be limited by law.
15. Your information
We handle the information you give us as described in our Privacy Policy. To pay you, we share your payment details with PayPal. We keep records of payments for as long as tax and accounting law requires, which may be after you leave the Program.
16. General
This agreement, with the Terms of Use and Privacy Policy, is the whole agreement between us about the Program and replaces anything said before it, including anything on our marketing pages.
You may not transfer it. We may transfer it to a company that acquires the PawCheck business.
If a court finds part of it unenforceable, the rest stands.
It is governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The state and federal courts located in Collier County, Florida have exclusive jurisdiction, and you and we each consent to that venue.
